Terms of Service

Welcome to KweliAuto ("KweliAuto", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of the KweliAuto website, mobile experiences, and related services (together, the "Service"), including our vehicle check tools, vehicle-history reports, marketplace, auctions, and wallet payments.

By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Eligibility & Accounts

You must be at least 18 years old and able to enter into a binding contract to use the Service. You are responsible for keeping your account credentials confidential and for all activity that happens under your account. Please give us accurate information and keep it up to date.

Business accounts — including dealers, finance partners, and insurance agents — require verification and approval before they can be activated. We may request supporting documents and may decline, suspend, or revoke a business account at our reasonable discretion.

2. Use of the Service

The Service may include, among other things:

• Car checks & vehicle history — estimates of market value, known issues, ownership and history intelligence.
• Marketplace — browsing, listing, and contacting parties about vehicles, parts, and services.
• Auctions — placing and accepting bids on listed vehicles.
• Wallet & payments — funding a wallet and using it for reports, subscriptions, and auction activity.

You agree to use the Service only for lawful purposes and in line with these Terms.

3. Wallet, Subscriptions & Payments

• Funds you add are held in your KweliAuto wallet and may be used to pay for reports, subscriptions, fees, and auction activity.
• Subscriptions unlock full vehicle-history reports and other premium features for the period you select. Subscriptions may renew as described at checkout.
• To place a bid in an auction you must have sufficient wallet balance to cover that bid.
• When you win an auction, the relevant amount may be held in escrow until the transaction is completed, cancelled, or resolved under our rules.
• We may charge fees for certain features (for example reports, subscriptions, or auction services). Applicable fees are shown before you confirm. Except where required by law, payments and fees are non-refundable once the service has been delivered.

4. Bidding Rules

• Bids are binding offers. By placing a bid you commit to honour it if you win.
• You must have enough wallet balance to back each bid you place.
• You may not place bids you do not intend to honour, manipulate prices, or coordinate bids with others to mislead the market.
• If you win, you must complete the purchase under the auction terms and any applicable escrow process. Failure to do so may result in loss of held funds, fees, and account action.
• We may cancel a bid or an auction where there is suspected fraud, error, or a breach of these Terms.

5. Vehicle Data & Reports Disclaimer

KweliAuto provides estimates and "intelligence" based on available data and modelling. Our reports, prices, scores, and insights are not guarantees and do not constitute professional, mechanical, legal, financial, or insurance advice.

Data may be incomplete, out of date, or inaccurate. You should independently verify any vehicle before buying, selling, financing, or insuring it — including a physical inspection and a review of original documents. You use our reports at your own discretion and risk.

6. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful, fraudulent, or misleading purpose.
• Post false, stolen, or infringing listings, or vehicles you have no right to sell.
• Scrape, copy, or resell our data or reports without permission.
• Attempt to bypass security, payments, escrow, or access another user's account.
• Harass, defraud, or harm other users, partners, or KweliAuto.
• Interfere with or disrupt the Service or its infrastructure.

7. Content & Listings Responsibility

You are solely responsible for the content, listings, vehicle details, prices, and communications you submit. You confirm that you have the right to post them and that they are accurate and lawful. We may review, remove, or refuse content that breaches these Terms, but we are not obliged to monitor all content and we are not a party to transactions between users.

8. Limitation of Liability

To the maximum extent permitted by law, KweliAuto is not liable for indirect, incidental, special, or consequential losses, or for loss of profit, data, or goodwill arising from your use of the Service or reliance on our reports or estimates. The Service is provided "as is" and "as available". Nothing in these Terms excludes liability that cannot be excluded under the laws of Tanzania.

9. Termination

You may stop using the Service at any time. We may suspend or terminate your account or access if you breach these Terms, if required by law, or to protect the Service and its users. On termination, certain obligations — including payment, escrow, and dispute terms — continue to apply.

10. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you. Continued use of the Service after changes take effect means you accept the updated Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the United Republic of Tanzania. Any dispute arising out of or relating to these Terms or the Service shall be subject to the jurisdiction of the courts of Tanzania, sitting in Dar es Salaam.
